In case an enforcement proceeding is conducted against a debtor for the purpose of making a payment, the latter has a right to apply to a bailiff and require to be provided a preliminary auction-related services on his/her immovable property. The application should include the accurate description of the realization property and its starting price. The price is identified by the owner and it shouldn't be less than the total amount of the enforcement assignment, fee, costs and the auction service due.
Application should be enclosed by a) fee for auction service that is identified by the Decree issued by the Minister of Justice and the pay confirmation document. b) updated extract from Public Register concerning the realization immovable property. This document should be provided within no later than 2 working days prior to application and c) the descriptive material for the property (photos, drafts, other documents necessary to support the property realization).
Preliminary auction is held once. In case it ends with no results, there is no obligation to re-hold it.
Interested individuals can apply for preliminary auction within 15 calendar days after a debtor is informed about the beginning of enforcement proceedings. After the deadline is expired, a preliminary auction can still be held in case there is a written consent of a creditor.
