"Debtor's Register" is a means applied prior to securement of the enforcement of fiscal suit - systematized electronic database of those individuals and legal entities, also organizations towards which the enforcement administration has been exercised since 1 January 2010. The database doesn't include tidings about public institutions and local self-governing bodies, also debtors of secured demand. A person is registered in Debtor's Register the moment he/she becomes the target of enforcement proceeding. Those who had faced the enforceemnt proceedings until 1 January 2010, can be registered in Debtor's Register on the NBE initiative.
NBE enforcement officer fulsills the debtor-related data registration in the Register on legal basis.
while registering, Georgia's MIA, PRA of the Ministry of Justice and all the banks operating in Georgia are obliged to immediately inform the relevant enforcement bureau in case they detect cases like property registration on the debtor or opening of a bank account. All similar activities must be ceased until the debtor is struck off the Register.
Striking off is fulfilled by NBE officers. (The decision is agreed to by the relevant NBE Head if there is the basis stipulated by sub-Article E of Article 2 of Paragraph 194 of Law on Enforcement Proceedings of Georgia. If the case refers to a enforcement officer, it should be agreed to by the Bureau Chairperson. Private enforcement officers register the relevant data and do the striking off as well.
Striking off takes place in the following cases: full payment is enforced, substitution of penalty by other sort of payment (in case of fines), cease of enforcement, withdrawal of enforcement sheet, or by court decision, or in case such item of the Register enrolled person is attached, the minimal relization price of which fully secures the enforcement demand.
NBE manages Debtor's Register. It provides constant update of the register database and its accessibility. The DR data is public. It is also posted on the NBE website (www.nbe.gov.ge). The webpage enbales any interested individual to get information about persons registered in the database.
The moment a citizen presents an appliction, NBE instantly releases relevant information and extractions about individuals and legal entities. The service due constitutes 10 GEL.
