After an enforcement officer has been commissioned a certain case, the quest of a debtor's property is commenced in parallel to sending a statement to the latter with the goal of enforcing the property and fulfill a creditor's demand.

An Enforcement officer applies to the following inspections to investigate a debtor property: tax inspection, MIA, Public Registry and banks in order to be provided a full information regarding the property state of a debtor, specifically: whether he/she has got any sort of movable or immovable property, any bank account or share in an enterprise, whether he/she has any kind of requirements towards third persons, if he/she has been registered as a sole trader and whether his/her property is right for transition (including tax mortgage right). The application is mandatory to fulfill.
During the quest of a debtor property, an enforcement officer applies the above-mentioned bodies regarding the sequestration register of the investigated property. The sequestrated property is bound to a creditor due and the costs of enforcement service. An enforcement officer is authorized to rest on the creditor-provided information with the goal of the property quest in case a creditor has any data concerning the property state of a debtor.
Moreover, an enforcement officer is allowed to make a debtor present his/her list of property within the 5-day deadline from the application. A debtor provides a written guarantee that the list presented by him/her is correct. The list is later checked by the enforcement officer and in case it turns out to be wrong, a debtor is charged in compliance with the rule stipulated by the Georgian legislature. The similar outcome will be faced if a debtor won't present the list of the property or if he/she refuses to provide a guarantee.
